Jana — End User License Agreement (EULA)

IMPORTANT — PLEASE READ CAREFULLY. By downloading, installing, or using the Jana mobile application, you agree to be bound by the terms set forth in this End User License Agreement ("EULA"). If you do not agree to these terms, do not download, install, or use the App.

1. User-Generated Content (UGC) Policy & Safety

Jana maintains a zero-tolerance policy for objectionable content or abusive users.

Jana is a private messaging and networking application that enables user-generated communication, including text messages, profile content, and shared media between connected users. Because user safety is our highest priority, this section is placed at the forefront of this Agreement.

1.1 Prohibited Content and Conduct

You agree that you will NOT use Jana to create, transmit, display, or share any content or engage in any conduct that:

Harassment or Bullying: Targets, intimidates, degrades, or threatens any individual or group, including persistent unwanted contact, name-calling, or psychological manipulation.
Hate Speech: Promotes violence, discrimination, or hostility against individuals or groups based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or any other protected characteristic.
Threats or Violence: Contains direct or indirect threats of physical harm, violence, self-harm, or terrorism against any person, group, or entity.
Defamation: Includes knowingly false statements of fact intended to damage another person's reputation.
Explicit or Adult Media: Shares pornographic, sexually explicit, or obscene material, including unsolicited intimate images or "revenge porn."
Exploitation of Minors: Contains, solicits, or promotes any content that sexually exploits, endangers, or depicts harm to minors in any form.
Illegal Activity: Facilitates, encourages, or instructs illegal conduct, including but not limited to drug trafficking, fraud, hacking, or the distribution of malware.
Spam or Deceptive Content: Sends unsolicited bulk messages, phishing attempts, or fraudulent solicitations.
Impersonation: Misrepresents your identity, affiliation, or relationship with any person or organisation.
Intellectual Property Infringement: Shares content that violates the copyright, trademark, or other intellectual property rights of any third party.

1.2 Content Moderation and Enforcement

Jana enforces the following moderation procedures:

The developer team reviews all reported content. Any reported objectionable content or abusive behavior will be acted upon and removed within 24 hours, and the offending user will be immediately ejected/banned from the platform.
Repeat violators or users engaged in severe misconduct (threats, exploitation, hate speech) will be permanently banned without prior warning.
We reserve the right to remove any content and terminate any account at our sole discretion if we determine that a violation of this EULA has occurred or is likely to occur.
All moderation decisions are final. Appeals may be submitted via email to santoshpatil@joinmandala.in within 7 days of enforcement action.

1.3 Built-In Safety Features

Jana provides the following built-in mechanisms to protect users:

Report/Flag Objectionable Messages: Users can report any message or content they find objectionable, abusive, or in violation of this EULA directly from within the App. Reported content is immediately flagged for developer review.
Connection Deletion and Reporting: Instead of a traditional temporary block, Jana allows users to permanently delete an abusive or unwanted user from their connections and submit a report. Once a connection is deleted, the connection is instantly severed, all chat history, messages, and profile visibility associated with that person are immediately and completely vanished from the reporter's account/device, and the account is flagged for developer review. The deleted user is permanently blocked from re-establishing any contact or re-adding the reporter.

These features are accessible at all times through the App's messaging interface and user profile screens.

1.4 Account Registration Agreement

By creating an account on Jana, you explicitly acknowledge and agree that:

You have read and accepted this EULA in its entirety, including the User-Generated Content Policy described above.
You will comply with the zero-tolerance policy for objectionable content or abusive users.
You understand that violation of these terms will result in immediate account suspension or permanent ban.

2. License Grant

Subject to the terms of this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded or Android devices that you own or control, strictly for your personal, non-commercial purposes.

2.1 Device Restrictions

This license is restricted to mobile devices that you personally own or control. You may not distribute, sublicense, rent, lease, or lend the App to any third party. You may not install the App on devices owned by others without their knowledge and consent.

2.2 Restrictions on Use

You agree that you will NOT:

Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the App.
Remove, alter, or obscure any proprietary notices, labels, or marks on the App.
Use the App for any unlawful purpose, or in any manner that violates this EULA.
Circumvent, disable, or otherwise interfere with any security, authentication, or access-control features of the App.
Use automated scripts, bots, or scrapers to access or interact with the App.

3. Party Acknowledgement — Apple App Store

This EULA is an agreement between you and Jana only, and not with Apple Inc. ("Apple"). Apple is not a party to this EULA and has no obligation whatsoever to furnish any maintenance or support services with respect to the App.

You acknowledge that:

Jana, not Apple, is solely responsible for the App and its content, including but not limited to product warranties, claims, regulatory compliance, and intellectual property matters.
Apple has no obligation to provide any maintenance, support, or update services for the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
Apple is not responsible for addressing any claims by you or any third party relating to the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; (iii) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that the App or your use of the App infringes that third party's intellectual property rights, Jana, not Apple, shall be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

4. Liability, Support & Warranty

4.1 Developer Responsibility

Jana is entirely responsible for:

The App's functionality, maintenance, and ongoing development.
All customer and technical support inquiries. Support can be reached at santoshpatil@joinmandala.in.
All content hosted, transmitted, or displayed within the App.
Any product warranty claims or product liability claims related to the App.

4.2 Warranty Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

4.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JANA, ITS FOUNDERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.

5. U.S. Export Compliance

You represent and warrant that:

You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country.
You are not listed on any U.S. Government list of prohibited or restricted parties, including the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List.
You will not use the App for any purposes prohibited by United States law, including the development, design, manufacture, or production of nuclear, chemical, or biological weapons, or missiles.

6. Privacy and Data

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal data. By using the App, you consent to the data practices described therein.

7. Intellectual Property

All intellectual property rights in the App — including but not limited to the Jana brand, name, logos, design, user interface, code, and all related materials — are owned by or licensed to Jana. Nothing in this EULA grants you any ownership interest in the App or its intellectual property.

You retain ownership of any content you create and share through the App. By sharing content through Jana, you grant us a limited license to transmit, store, and display that content solely for the purpose of providing the App's communication services.

8. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including but not limited to:

Violation of this EULA, including the User-Generated Content Policy in Section 1.
Any conduct that we determine, in our sole discretion, is harmful to other users, to us, or to third parties.

Upon termination, your license to use the App will immediately cease. Sections 1, 3, 4, 5, 7, and 9 of this EULA shall survive termination.

9. Governing Law and Dispute Resolution

This EULA shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles. Any disputes arising from or related to this EULA shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

Before initiating any legal proceeding, you agree to notify us in writing at santoshpatil@joinmandala.in and allow 30 days for us to attempt to resolve the dispute amicably.

10. Modifications to This EULA

We reserve the right to modify this EULA at any time. Material changes will be communicated through the App or via email. Your continued use of the App following notification of changes constitutes your acceptance of the revised terms.

11. Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of this EULA, Apple shall have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
